SMS Messaging Terms and Conditions

These SMS Messaging Terms and Conditions (these "Messaging Terms") apply to the text message program operated by Key Funding Holdings LLC, doing business as KeyFunding ("we," "us," or "our"), through keyfunding.net. By providing your mobile phone number and agreeing to receive text messages from us, including by checking the SMS consent box or submitting our application, you agree to these Messaging Terms. If you do not agree, do not opt in and do not provide your mobile number for messaging.

1. Program Description

When you opt in, we may send you recurring text messages relating to your commercial funding request and business account, including account alerts, verification codes, application status updates, servicing notices, customer-service replies, and information about merchant cash advance and working-capital options and funding partners that may be available to your business. Some messages are informational and some are promotional; both are covered by your consent.

2. Your Consent

By providing your mobile number and opting in, you give your prior express written consent to receive text messages from KeyFunding, its third-party purchasers and funding partners, and authorized service providers at the number you provide, sent using an automatic telephone dialing system or similar technology. You understand and agree that:

  • Your consent is not a condition of any funding or the use of our services. You can still submit a funding request and be considered without agreeing to receive marketing text messages.
  • Consent applies specifically to the mobile number you provide, and you represent that you are the subscriber or customary user of that number and are authorized to consent.
  • You will notify us if you change or relinquish the mobile number so we can update our records.

3. Message Frequency

Message frequency varies based on your activity and the status of your funding request or account, up to approximately 12 messages per month.

4. Message and Data Rates

Message and data rates may apply to each message sent to you or by you, depending on your mobile carrier and plan. We do not charge you for the text messages we send, but your carrier's standard rates still apply. Contact your wireless carrier for details about your plan.

5. How to Opt Out

You can cancel the SMS program at any time by texting STOP to the number from which you received our messages (you may also text CANCEL, END, QUIT, UNSUBSCRIBE, or REVOKE). After you send the message, we will send you a reply confirming that you have been unsubscribed. After that, you will no longer receive text messages from that program. If you want to join again, sign up again as you did the first time and we will resume sending messages to you.

6. How to Get Help

For help with the SMS program, text HELP to the number from which you received our messages, or contact us at support@keyfunding.net or +1 (877) 416-4725. In response to a HELP request, we will provide our contact information and program details.

7. Carrier Liability

Carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier and is not guaranteed. Supported carriers may change from time to time, and we are not liable if messaging services are not available in your area or on your carrier.

8. Privacy

Information you provide in connection with the SMS program is handled in accordance with our Privacy Policy. We will not sell or share your mobile phone number with third parties for their own independent marketing purposes. Your number may be shared with the third-party purchasers, funding partners, and service providers necessary to deliver the messages and services you request.

9. Changes to These Messaging Terms

We may update these Messaging Terms from time to time to reflect regulatory changes or operational adjustments. Changes are effective when we post the updated Messaging Terms here, and the "Effective" date above will reflect the most recent revision. Your continued participation in the SMS program following a change constitutes your acceptance of the updated Messaging Terms.
